Welcome to linkz.gg ("Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the linkz.gg platform and related services (the "Service"). By using or accessing the Service, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Service immediately

Acceptance of Terms

By accessing or using the Service, you affirm that you are at least 13 years of age and legally eligible to enter into these Terms. You agree to comply with all applicable laws, regulations, and these Terms. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

Account Registration

To access certain features, you may be required to register for an account. You agree to:

• Provide accurate, complete, and current information.
• Maintain the confidentiality of your login credentials.
• Notify us immediately of any unauthorized use or suspected breach of your account.
• Not use any username that is illegal, trademarked, offensive, vulgar, or otherwise in violation of applicable laws or regulations.

We reserve the right to reject or remove usernames, and to take any appropriate action to maintain a safe and respectful environment for all users.

We further reserve the right to terminate, remove, suspend, or edit your account at any time and for any reason, with or without prior notice.

Acceptable Use

You agree to use the Service in accordance with all applicable laws, regulations, and platform guidelines. By using linkz.gg, you further agree not to, including but not limited to, the following:

• Use the Service to conduct or promote any unlawful activity.
• Transmit, upload, or distribute any viruses, malware, spyware, or other harmful, disruptive, infringing, or illegal content or files.
• Interfere with, disrupt, or attempt to interfere with the proper functioning of linkz.gg, including its servers, network infrastructure, or systems.
• Attempt to bypass, disable, or circumvent any access control or security measures implemented on linkz.gg.
• Impersonate any individual or entity, or falsely represent your affiliation with another person, group, or organization. This includes misrepresenting content as being officially endorsed by linkz.gg.
• Use, or allow others to use, automated scripts, bots, or scraping tools to collect information from linkz.gg or interact with the Service in unauthorized ways.
• Access or attempt to access another user's account, service, or system without proper authorization.
• Post or display sexually explicit content, pornographic imagery, or other materials that are violent, hateful, discriminatory, or otherwise offensive on your account or public profile.

We reserve the right to determine what constitutes a violation of this Acceptable Use Policy and to take any necessary actions, including content removal, account suspension, or permanent termination, without notice. Severe or repeated violations may be reported to appropriate legal authorities.

Content Ownership, User Responsibilities, and License

User-Posted Content and Licensing Rights

You are solely responsible for any content you submit, post, upload, or otherwise make available on or through the Service. This includes ensuring that such content is lawful, reliable, and appropriate, and that it does not violate the rights of any third party.

If any portion of your content incorporates elements owned by a third party (e.g., images, text, music, trademarks), it is your responsibility to secure all necessary rights, licenses, and permissions to use and share that content on linkz.gg. By posting content on linkz.gg, you represent and warrant that:

• You own the content or have secured appropriate legal rights to post it.
• Your content does not infringe upon any intellectual property, privacy, publicity, or other legal rights of others;
• Your content complies with all applicable laws and these Terms.

By posting or sharing content on or through linkz.gg, you grant us a worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, reproduce, store, host, adapt, modify, publish, distribute, publicly display, and create derivative works from your content solely for the operation, promotion, and improvement of the Service. This license will continue until your content is deleted from the Service, except:

• Where your content has been shared with other users and they have not removed it.
• Where retention is legally required or permitted (e.g., for compliance or legal purposes).

While you retain ownership of your content, you agree to indemnify and hold harmless linkz.gg, its affiliates, and its operators from any claims, disputes, damages, or liabilities arising out of your content, including any third-party claims related to rights infringement or legal noncompliance.

Platform-Provided Assets

If linkz.gg provides you with any proprietary assets such as icons, badges, templates, graphics, videos, or illustrations for use with your profile or page, you may only use them within your linkz.gg page or services. You may not copy, distribute, alter, or use these assets outside of the linkz.gg platform.

Use of these assets is also subject to any additional written guidelines or third-party licensing terms that may apply.

Prohibited Content

You agree not to post, upload, link to, or otherwise share any content that:

• Violates any applicable local, state, national, or international law or regulation;
• Infringes upon any intellectual property rights, personal privacy, publicity, or other legal rights of others;
• Is defamatory, abusive, harassing, obscene, pornographic, or otherwise offensive or objectionable;
• Promotes violence, discrimination, illegal activities, or hate speech targeting individuals or groups;
• Contains malware, viruses, Trojan horses, spam, or any other malicious or deceptive code;
• Attempts to circumvent or interfere with any platform security or moderation mechanisms.

linkz.gg reserves the right to determine what constitutes a violation of this policy and may take any actions it deems necessary, including but not limited to content removal, profile suspension, account termination, or reporting to law enforcement agencies.

Intellectual Property

All content and materials on linkz.gg, including but not limited to our platform's design, logo, branding, features, codebase, graphics, and user interface, are the exclusive property of linkz.gg or its licensors and are protected by United States and international copyright, trademark, and intellectual property laws.

Nothing in these Terms shall be construed as granting you any license, ownership, or other rights to any of our intellectual property, except for the limited, revocable license to use the Service as explicitly permitted under these Terms.

You may not:

• Reproduce, distribute, publicly display, or create derivative works from our content without our express written permission;
• Use our name, logo, or brand elements in any way that implies an endorsement or partnership without authorization;
• Modify, decompile, disassemble, reverse engineer, or otherwise attempt to derive source code from any part of the Service, except as expressly permitted by applicable law.

Service Availability

We strive to maintain a secure, reliable, and continuously available Service. However, we do not guarantee uninterrupted access to the platform. The Service may experience temporary outages due to maintenance, updates, or system issues. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and without liability for any resulting disruption or loss.

Payments and Fees

All payments for services on linkz.gg are processed in United States Dollars (USD). Prices listed on the platform are exclusive of applicable taxes, handling fees, or additional charges unless stated otherwise. Final charges, including any applicable taxes or fees, will be presented during the checkout process.

Some premium services or custom products (e.g., badge design, visual assets) may include limitations or terms regarding revisions or usage. Any additional modifications requested by the user may incur additional fees, as outlined during the ordering process or communicated separately.

Refunds

All payments made to linkz.gg are non-refundable, unless otherwise required by applicable consumer protection laws in the United States or where a billing error has occurred directly due to our systems. Refunds are issued only in exceptional cases and at our sole discretion. We reserve the right to deny refund requests that fall outside these parameters.

Termination

We reserve the right to suspend or permanently terminate your account or restrict your access to the Service at any time, for any reason, and without prior notice or liability. This may include, but is not limited to, violations of these Terms or applicable laws, abusive behavior, fraud, or other conduct deemed harmful to the Service or other users.

Upon termination:

• Your right to access and use the Service will immediately cease;
• Any licenses granted to you under these Terms shall terminate;
• We may delete your account and any associated data, except where retention is required for legal, operational, or backup purposes;
• Any provisions of these Terms that by their nature should survive termination shall continue to apply, including, but not limited to, intellectual property rights, indemnification, disclaimers, and limitation of liability.

Third-Party Services and Links

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by linkz.gg. These links are provided for your convenience and do not imply any endorsement or responsibility for their content, services, policies, or practices.

Your interactions with any third-party services are governed by their respective terms and privacy policies. We are not responsible for any harm or loss caused by your use of third-party platforms, and you access them at your own risk.

Security

We take the security of your personal information and account seriously. linkz.gg implements industry-standard measures to safeguard your data, including technical, administrative, and physical security protocols designed to protect against unauthorized access, disclosure, alteration, or destruction.

While we strive to protect your information, no method of transmission over the internet or electronic storage is 100% secure. As such, we cannot guarantee absolute security. You acknowledge and agree that you provide your information at your own risk.

You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account. If you suspect any unauthorized use or security breach, you must notify us immediately at support@linkz.gg

We may, but are not obligated to, investigate any suspected breach and take appropriate actions, including suspension of your account, system monitoring, or notification of law enforcement authorities if necessary.

Limitation of Liability

To the maximum extent permitted by applicable law, linkz.gg and its affiliates, officers, directors, employees, or agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for

any loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of, or inability to access or use, the Service;
• Any unauthorized access, use, or alteration of your content or account;
• Any errors, bugs, viruses, or security vulnerabilities present in or transmitted through the Service.

Our total liability to you for any claims arising from or related to the Service is limited to the amount you paid (if any) for accessing or using the Service in the six months preceding the claim.

Indemnification

You agree to defend, indemnify, and hold harmless linkz.gg and its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including reasonable attorneys fees) resulting from:

• Your use or misuse of the Service;
• Your violation of these Terms or any applicable law;
• Your infringement or misappropriation of any third party's rights, including intellectual property or privacy rights;
• Any content you submit or share via the Service.

Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. Your use of the Service is at your sole risk. We disclaim all warranties of any kind, express or implied, including, but not limited to:

• The implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
• Any warranties that the Service will be uninterrupted, error-free, or secure;
• Any warranties regarding the quality, accuracy, or reliability of the results obtained from the Service.

We do not guarantee that the platform will meet your expectations or perform without interruption or delay.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Florida, without regard to its conflict of law provisions.

You agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Florida for the resolution of any legal disputes arising out of or relating to your use of the Service, unless otherwise required by law.

Dispute Resolution

Before initiating any formal legal action, you agree to first contact us at support@linkz.gg and attempt to resolve the dispute informally. We will attempt to resolve the dispute promptly and in good faith. If a resolution cannot be reached within thirty (30) days of your initial contact, both parties agree that the dispute shall be resolved through final and binding arbitration, except that either party may bring an individual action in small claims court. The arbitration shall be conducted under the rules of the American Arbitration Association (AAA) and governed by the Federal Arbitration Act. It will take place in the State of Florida, unless otherwise agreed in writing. You and linkz.gg agree to resolve any disputes in arbitration on an **individual basis only**, and not as a class, collective, or representative action. Class action and collective arbitration are not permitted. Nothing in this clause shall limit your statutory rights or prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction.
